Wall Legislator's Gun Permit Privacy Bill Passes Assembly

Bill seeks to keep gun permit holders' information away from the public

 

Legislation that would exclude from public release the names of gun permit holders handily passed the state Assembly Thursday.

The Assembly voted 77-0 in favor of A-3788, a bill introduced by Assemblyman Dave Rible of Wall, along with Assemblyman Ronald S. Dancer, both R-Monmouth and Ocean. The bill seeks to prohibit public access to the names and addresses of gun permit holders under the state’s Open Public Records Act. The bill now moves to the state Senate.

Rible previously has said he is opposed to the release of such information because it could prove potentially dangerous to gun owners who follow the rules and to law enforcement officers.

“Releasing personal information about those who have firearms permits or licenses puts law enforcement officers and law-abiding citizens in harm’s way,” Rible, R-Monmouth and Ocean, said in a statement. “This legislation will codify that obtaining such information is restricted to those in law enforcement or the courts.”

The bill is in reaction to the recent publication of gun permit holders’ names and addresses in a New York newspaper.

The Journal News in White Plains, NY, published the article, “The Gun Owner Next Door: What You Don’t Know About the Weapons in Your Neighborhood,” which published the names and addresses of more than 30,000 handgun permit holders in Westchester and Rockland counties. The article, which obtained the names and addresses from publicly available documents, also contained a map of the handgun permit holders.

The paper received widespread criticism for the move, and when the outrage became threatening, it hired armed guards to protect its main office and a bureau. Employees who felt unsafe at home were offered hotel rooms, at the paper’s expense.

Rible has compared the availability of gun owners’ information to that of lottery winners.

In December, the Assembly unanimously passed a bill that would allow state lottery winners to keep their identities private for up to one year. The state lottery commission, a state agency, collects the names and addresses of lottery winners, which are considered public records. The bill has not yet been taken up by the Senate.

“It’s okay to win the lottery and remain anonymous, but not for gun owners,’’ Rible has said. “It doesn’t seem right.”

I disagree. There they go down that slippery slope. What is the next public record that they decide shouldn't be public? It is a knee jerk reaction. Just the same as the reaction by gun enthusiasts is to run out and buy more guns because the President is going to take your guns away.

I think Laura should move to a country like Russia, China or Iran where they don't have the 2nd Amendment so she can feel safe.

This has nothing to do with the 2nd Amendment. It's a policy that denies the public information. I am disappointed that our elected officials spent an iota of energy on this bill. It is indeed a knee jerk reaction to one article in a newspaper trying to make a point about the proliferation of guns. Monmouth and Ocean county have no bigger issues at this time I suppose. Gun permit holders know that the information is public record. What is the big deal, why is that information so special that it needs to have unique protection and exemption from the public record.

SSK, It is none of your Business if I or anyone else owns a gun or many guns and what type of guns we own or don't own...Also it is none of my business what guns you own or don't own....why would anyone want to know if i own a gun anyway? Gun registration in New Jersey is not mandatory. Sorry if that scares the heck out of you.

Woo hoo, Good news, now papers should publish whom received taxpayer funded abortions and collect welfare, we all need to report fraud and I dont feel safe having my children around people that have on regards for human lives.

ssk, it has everything to do with the second amendment and the privacy of our, public officials, law enforcement officers and law abiding citizens. Maybe the public records should be made available for illegal taxpayer funded abortions and welfare cheats who commit fraud. I think you should join Laura and move to a countries like Russia, China or Iran where you don't have any freedoms, privacy or rights.

The second amendment is quite short and says nothing about privacy. The bill passed was a separate issue in my opinion.. but then again it's only my opinion, which apparently I'm not entitled to because it differs from yours.
Thank you for pointing out other countries I can move to because I don't agree with you. You forgot about North Korea.. I hear the food is great.
Just be careful, if you banish me and others like me, who will be left to foot the bill for all the "illegal taxpayer-funded abortions" and rampant "welfare cheating".

Question for the Patch: Why is Mr. Rible being from Wall mentioned? As an Assemblyman, doesn't he represent a district? Let's face facts. This bill was introduced because an out of control "media outlet" chose their own political agenda over the safety and welfare of law abiding citizens. They allege that they are "protecting the public". If true, they would have published the list of sex offenders and their personal info right along with it.. One must admit the employees of the NY paper must be a sick bunch when they think gun owners are a greater threat to society than sex offenders, huh?

so.. ssk.. someones privacy doesn't seem to be a problem with you.. lets see how that privacy applies to you.. .. Do you own a gun? there might be people on here who would like to know.. if you don't own a gun maybe you should publish your name and address on here. no privacy right , you see, ssk if the names and addresses of gun owners are made public then it isn't very hard to figure out who the non-gun owners are ,that's what I have a problem with..

You can find out anything you want about anyone for a few dollars on the internet. I don't live under the assumption that there is much privacy. Whether I have a gun permit, a dog permit or a pool permit it's no secret. If I'm a public employee you can see how much money I make and how many vacation days I get. The journalists who published the information had questionable journalistic integrity, but the information IS public record. There are several gun owners in my family and they are not particularly paranoid about people knowing they have a gun. I think it's expected with certain professions. I have a good alarm system and that works for my peace of mind.

If you ever hear your alarm go off in the middle of the night simply call the Police then order a pizza and see who gets there first........And no, I won't tell you if I have a gun because it's none of your business.

why pay for it when I can get it for free ? I dont even need to know your name or address, just point and click, all the info I need is there for free.. while your address has a gun your neighbor (me) doesn't. thats what I'm paranoid about.. alarms are great, but how many are armed 24/7? I'll take a hand gun over any alarm system any day that works for my peace of mind.
