Point Boro Boy Firing BB Gun Under Police Investigation
Boy fired BB gun into middle school windows
A 15-year-old boy is under police investigation for having a BB gun and firing it into Memorial Middle School windows, police said Wednesday.
Police received a report at about 1 p.m. Tuesday that a male dressed in black had a handgun at the middle school field, said Captain Richard Larsen.
When police arrived at the scene, they found a 15-year-old with a BB gun who was with two 14-year-olds. The older boy had fired the BB gun at the school, cracking at least a few windows, Larsen said.
The 15-year-old was taken into custody, interviewed at the police department and then released to the custody of his mother, Larsen said.
No charges have been filed so far, but Officer Chris Woit is continuing to investigate, said Larsen, adding that a BB gun is a firearm and can be extremely dangerous.

What do you mean no charges have been filed this kid needs to locked up and charged as an adult.

Mr. Hennessey: As the story states, "No charges have been filed so far, but Officer Chris Woit is continuing to investigate......" Just because no charges have been filed so far does not mean they will not be filed. Often, police put extra time into an investigation for good reason before filing charges. Let's give them a chance to do their jobs. They truly are working on it. For the most part, minors are not treated as adults in the eyes of the law, barring some cases involving the most serious crimes, but that call is made on a highly individualized basis.

Hi Denise, I understand that, and think its good policy. In this situation though something this frighting, this boy should be in custody right away he was shooting at a school he has serious issues.Send a message to boys like this will get in trouble right away! Protect our town.
On a brighter note whats going on with the best burger vote? Thanks fotr the quick response.

My tax dollars are going to have to pay for the damages if his parents aren't held accountable. Kids get caught doing stupid things, and I don't necessarily think that they should always go through the court system, but the do need to be held responsible.

Well thats not enough this kid was shooting at a school for heavens sake, he was not shooting at cans in the woods. He should be held and checked out by a doctor, his parents should be checked out by the state. This is not something that should be treated lightly shooting at a school at 15 whats next?

about 15 years ago a class mate of mine at Point Borough High School decided it was a good idea to drive around in his new Ford Explorer and take shots at people with a BB gun. That was a big deal then. It is my understanding that the state of NJ considers any air rifle (BB or Pellet) a firearm. In order to purchase a BB hand gun, you actually need the state issued firearm purchasers card in addition to a hand gun permit. If the state considers these guns to be actual firearms, the kid should be treated as if it was an actual gun.

Lucy, the Borough does not have a detective by that name. Moreover, the story clearly states the name of the officer doing the investigation. I had to delete your comments because we cannot have readers putting forth names of persons who may or may not have possessed or fired a BB gun or who may have committed any other crime for that matter.

@Ghost ... Name calling aside, so are so right. My nephews, living in PA, have both been shooting since their pre-teen years, taking NRA sponsored gun safety courses. They regularly hunt with their father. First day of deer hunting season in PA is a school holiday! I'm going to forward a link to this story to my sister-in-law, you'll hear her laughing all the way from PA. And the laughing will be at both the knee-jerk reactions from some of the people commenting, and the other will be at the parents for not properly training the boy in firearm safety and being unfamiliar with the laws and regulations in the state of NJ. The biggest laugh will be at all the citizens of NJ, for allowing the Libs to trample on our Constitutional right and sitting idly by as our rights erode.

Certainly, firing a BB gun at the school is unacceptable. That the state has classified BB guns are a "firearm" is ludicrous, but unfortunately it's the law. But good god people, it was a friggin' BB gun! Not a sawed-off shotgun! And not an automatic weapon! "Columbine?" really, you're comparing a kid with a BB gun to Columbine? Standing in the middle of an open field with two other kids firing a pea sized pellet at a building? Because he was wearing black? So, if he was dressed in a suit and tie it changes it, or jeans and a tee-shirt?
Where's his parents? Probably at work. I'm a parent and I'm not joined at the hip of any of my children, and neither are any of you. Kids do stupid things, usually when parents aren't around.
In most other states that aren't overrun by knee-jerk liberals looking to take away every one of our Constitutional rights, BB guns are considered a toy. The kid did a stupid thing. He doesn't need to go to a doctor or a psychiatrist, he doesn't need to go to jail, he needs a proper punishment from his parents, and directed to pay restitution to the school system for the window repairs. You're going to mark him for life as some sort of wing-nut for a stupid teenage prank. Some of you people need to get a grip.

Da Poppa you are clueless. It doesn't matter if you think a BB gun is a toy or not, he fired it at a school, with intent to do damage, and possession of that weapon is illegal. As for your parenting comment, I know here MY kids are, because they are joined at my hip, and they don't do stupid things. You need to get a grip, you are part of this problem with your view of the system.

@Pirate, How do you know what his intent was? What difference does it make that it was a school? It's not like it was full of students. All you people should leave the investigation up to the people who should be doing the investigation and mind your own damn business. The police are not stupid, I'm pretty sure they can handle a kid doing something dumb.

@pirate ... So you have the smartest kids in the world ... They've never made a mistake, because youre always there making the choices for them. Congratulations. How's life in your fantasyland? Read my comment. I acknowledged the act was illegal, I acknowledged that he needs to be punished, and I acknowledged he needs to make restitution. I also point out that he's a kid that made a mistake and doesn't need to be analyzed by some crackpot therapist or sent to jail because he did a stupid thing.
What I also pointed put is that the fact that a toy has been made illegal has to do with knee-jerk liberals, people that think they know better than everyone else. If its true that your kids NEVER leave your sight, are NEVER off your hip, then I guarantee this ... Your kids will NEVER survive in this world, because they've NEVER had the chance to explore, screw up and learn for their mistakes. Because you NEVER let them be a kid.
Get a grip ...

Hey Ghost rember you insulted me first and I agree with all yours and Da Poppas points. Except this is a young boy shooting at a school there is a serious mental breakdown somewhere. He is not out shooting at cans in the woods as I did. With all the violence in the world today this should not be tolerated and he should be punished severly. Mr.Ghost this is all in good fun I have a resturant in the beach and would love to sit and have a slice of pie with you one day and continue our friendly banter!!

It isn't any different than if a kid had broken some windows with rocks and the penalties should be no different with the parents paying for the damages. In PA a BB gun is considered a toy which when misused has the possibliity to do harm. According to NJ's irrational gun laws even an extremely low powered spring powered BB rifle is classified as a firearm. This means that if the fifteen year old was classified as an adult he might be subject to a mandatory prison sentence of as much as five years. Some of our legislators want to increase the mandatory penalties to as much as 10 years. That would be a worse crime than what one stupid teenager did.

Is the BB gun in question a "genuine Daisey Red Ryder...you'll shoot your eye out, kid" or a "Varmint Killer" that has enough power to snuff out a small animal? Also, does it LOOK like a automatic firearm which could be mistaken for a real gun? For the kid's own protection, as well as the community around him, some caution should be exercised.

Caution? Certainly. "Send the kid to a shrink because he's a step away from strapping on ammo and carrying an AK47 into a school and he should be sent to a jail and surgically attach to his parents hip for the rest of his life" over the top reactionism? Absolutely not.

Da Poppa, how do you know the child doesn't need a therapist? The Boro has a problem with juveniles in this town. What's your answer? Slapping them on the wrist. 15 is old enough to know what's acceptable and what isn't. This is no 10 year-old that we are talking about.
Da Poppa
8:34 am on Friday, July 13, 2012
Laura, how do you know he does need therapy? He needs proper punishment, not a trip to someone that will ask what bothering him and how we can help him, that's not a punishment. That's the slap on the wrist you sneer at.
And the problems with juveniles in this town is bigger than some dopey kid with a toy shooting pellets at a school. It's the lack of control exercised over kids at school, where drug use and dealing runs rampant; it's the police in this town cruising around town in a car instead of being actively engaged in crime prevention; and most importantly it's the parents at home being too lazy to take an interest in their children, their children's friends and their children's activities. Not in a joined at the hip sort of way, but a genuine interest in the child's activities and well being.
I'm not blind to the juvenile crime problems in this town. The Barth story reported on this site is the tip of the iceberg. And the daughter didn't just start this life of crime. It didn't spring of whole cloth out of thin air. And it is not an isolated incident. But don't make the mistake of thinking dishing out a non-punishment of therapy or and unjust punishment of jail for a teenage prank will solve anything.

NJ has very strict rules when it comes to firearms. Yes he should be charged with poss of a firearm as well as discharging one in public not to mention additional charges for being in a school zone. All of this will probably be charged as a juvenile but he needs to be charged. Also evaluated by a psychologist.

Websters definition of a firearm - a weapon by which a shot is discharged by gunpowder. No matter how the liberal gun grabbers have tried to redefine the term, a BB gun is not a firearm. It's a toy that can be dangerous if used incorrectly. Like a baseball bat. People have been killed by a baseball bat, but that's not the intent of the toy.
NJ has unconstitutional laws concerning firearms. The government and law enforcement want to take away the right of every law abiding citizen in the state to bear arms. The right to bear arms is in the Constitution to assure that We The People will be able to protect ourselves from the government.
Soon you won't be able to pick your nose in a school zone. It's another concept that's been dangerously perverted by people that want to control every aspect of our lives.
The kid does NOT need a therapist, but some dopey judge will probably make him go to one.
To paraphrase Jack Nickelson, "what this country needs is an enema!"

The BB gun in this case is smarter than most people on this post. This is a simple case of mischief...Boys will be boys..Not a smart thing for the kid to do,he's caught now...Explain to the "boy" which he is, that this is a Bozo nono!!! Take his gun away, have his family pay for damage, give him a little community service(cleaning the school grounds and learning to respect public property etc etc)..We don't need to "pole vault over mouse turds on this one,do we?" Da Poppa thanks for common sense, too bad it;s not so common anymore!!!
