Point Beach Appealing Court Decision Invalidating Parking Plan

No more free parking at Silver Lake lot on Arnold and Ocean avenues

Point Beach has filed a notice of appeal to fight a Superior Court decision to invalidate the summer, overnight parking plan in District 4 and a small section of District 3.

Meanwhile, there is no valid parking plan in place in Point Beach and no more free parking in Silver Lake parking lot on Ocean and Arnold Avenues.

However, Point Beach Council may establish a new parking plan at the meeting coming up on Tuesday night at Borough Hall on New Jersey Avenue. Council has introduced two different parking plans and will either decide to approve one of them or leave the town without one.

Because another parking plan may be established this summer, the municipality has issued a notice, published on its website, asking residents not to dispose of their parking placards.

Residents, taxpayers and many employees of local businesses had been given placards entitling them to park in otherwise restricted street parking spaces included in the parking plan.

The municipal notice says:

"As a result of litigation filed against the Borough of Point Pleasant Beach, the parking plan implemented on May 15, 2013 in Districts 3 and 4 has been declared invalid, on an issue unrelated to the parking program, by the Superior Court of New Jersey and will not be enforced.

The street signs related to the plan have been removed and free parking after 11 p.m., in the municipal parking lot located on Ocean and Arnold Avenues, has been suspended until further notice.

PLEASE DO NOT DISCARD OR DESTROY YOUR PASSES.

The Borough is drafting the same, or a very similar parking plan, with the intent of having it in effect before the end of this summer season and you will need to display your placards when enforcement resumes.
