The council votes Tuesday night to undo the early bar closing ordinance passed in 2012
The Point Beach Council voted unanimously on Tuesday night to undo an early bar closing ordinance passed last year. The vote during the council meeting at Borough Hall was adoption of an ordinance to repeal an ordinance adopted last year to require all bars and restaurants in Point Beach to stop serving alcohol by midnight. Last year's ordinance rolling back the "last call" to midnight never went into effect because the state Division of Alcoholic Beverage Control issued a stay. Regarding last year's early bar closing ordinance, Mayor Vincent Barrella said on Tuesday night, "When this was adopted last year, it was a lawful ordinance. I wish the state would show as much interest in us with Sandy as with things they shouldn't stick their …

Barrella and Mayer have words over parking plan
Point Beach Council late Tuesday night unanimously tanked an ordinance mandating that bars stop serving alcohol at midnight, but there was a lot of acrimony over talk of a new parking plan. The council, as anticipated, voted on first reading to repeal an ordinance for bars to stop serving alcohol at midnight, a measure that was blocked temporarily by the state Division of Alcoholic Beverage Control last summer. The ordinance to keep closings at 2 a.m. is scheduled for public hearing and adoption at the Feb. 19 meeting. The repeal was prompted by the town and Jenkinson's Boardwalk coming to an agreement last month for the town to repeal the measure and for Jenkinson's to drop all legal action against the earlier bar closing ordinance and …

Retail sales of hamsters, guinea pigs, mice, rabbits, gerbils, rats and ferrets still allowed
Point Beach is outlawing the retail sale of dogs and cats, following a similar move recently made first in Point Borough, then in Brick and Manasquan. The second reading and adoption of the ordinance prohibiting retail sales of dogs, cats and certain other mammals was supported in a unanimous vote at the Point Beach Borough Council meeting at Borough Hall on Tuesday night. "This ordinance, if adopted would ban the sale of dogs, cats and other mammals, other than hamsters, guinea pigs, mice, and rabbits, within the Borough," states the ordinance summary at the bottom of the ordinance on the municipal website. On Tuesday night, the council agreed to add "gerbils, rats and ferrets" as exceptions, so they can still be sold in pet stores. …

Unusual mayor-council alliances tank ordinance to bill businesses for part of cost
Point Beach Council voted nearly unanimously to fix an Irene-ravaged section of boardwalk without help from boardwalk businesses, right after an initial move to bill businesses for part of the cost narrowly failed. The lengthy discussion, and, ultimately, the votes on the issue, did not play out along the usual political alliances. Councilmember Tim Lurie agreed with Mayor Vincent Barrella to not pass the first ordinance to bill Jenkinson's and Risden's for part of the cost, and disagreed with Councilmember William Mayer; Councilmembers Michael Corbally and Kristine Tooker agreed with Mayer and disagreed with Councilmember Bret Gordon; Councilmember Stephen Reid disagreed with Mayer, but agreed with Barrella and Gordon. Yes, it was unusual…

Town may impose assessment fees on Jenkinson's and Risden's
In late summer of 2011, a number of the Storino family members were on Jenkinson's Boardwalk, welcoming Gov. Christie to Point Pleasant Beach. During a break in the official activities of the day, the elder Vincent Storino, one of Jenkinson's owners, shot a sour look at the battered boardwalk and complained, "The mayor, he never fixes the boardwalk." When asked, "Whose responsibility is it to fix the boardwalk?" Storino replied, emphatically, "The town's." Now the town is hoping to bang a chink in that assured answer, taking the first step in compelling the Storinos, owners of Jenkinson's Boardwalk, and Risden's, to help pay to fix a piece of the boardwalk damaged by tropical storm Irene a year ago, which actually prompted Christie's visit…

State ABC won't let town enforce midnight bar closings yet
Point Beach bars can stay open until 2 a.m. for now until an appeal is decided, ruled the director of the state Division of Alcoholic Beverage Control on Friday night. The town is temporarily barred from enforcing an ordinance, adopted on May 15, that would have compelled all bars in Point Beach to stop serving alcohol at midnight starting Sunday, now that ABC Director Michael Halfacre has granted a "stay." (See attached PDF). Halfacre wrote in his ruling that compelling Jenkinson's and Martell's to close at midnight while the appeal they filed against the ordinance is pending, would be unfair. "Should the Appellants prevail after a full hearing, there is no method of redress for them to recoup the financial losses they would incur while …

Town and boardwalk bars went before state ABC on Tuesday
Point Beach is telling the state it has every legal right to shut down booze sales at midnight, and the town and the boardwalk bars argued their cases at a state hearing on Tuesday. Those are the two most recent developments in the ongoing issue of earlier cut-off of alcohol sales: that the town has responded to an appeal filed by Jenkinson's and Martell's and both sides appeared before the state Division of Alcoholic Beverage Control (ABC) at a hearing in Trenton on Tuesday. A recently-adopted ordinance mandates that bars stop serving alcohol by midnight, two hours earlier than the current cut-off, starting July 1. Jenkinson's and Martell's reacted to the ordinance by appeaing to the state ABC, arguing that the state should invalidate the…

District 4 parking plan warnings start Friday; ticketing starts June 22
District 4 businesses will get parking placards for employees so they are exempt from the District 4 parking plan restrictions that go into effect on June 22. The placards for employees will have the name and address of the businesses they work for, but not the names or addresses of individual employees, so the placards can be shared among employees, said Municipal Clerk Maryann Ellsworth on Wednesday. That was one of several revisions to the new District 4 parking plan that was adopted, as an ordinance, by Point Beach Council at Borough Hall on Tuesday night. Councilmembers Stephen Reid and William Mayer, who have always been against the parking plan, voted against the ordinance, while it was supported by councilmembers Kristine Tooker, …

Two ordinances, one for midnight closing and one for bars to pay fees to stay open later, are carried until May 15 meeting
Ordinances calling for bars to stop serving alcohol two hours earlier and one allowing bars to pay fees to stay open later were both "carried," or postponed until the May 15 Point Beach Council meeting by the Point Beach Council on Tuesday night. The decision to "carry" was made at the request of an attorney for Jenkinson's to give boardwalk business owners and elected officials more time to meet privately to try to come up with a solution. The votes to carry both ordinances were cast by council members Bret Gordon, William Mayer, Tim Lurie and Stephen Reid. Council members Kristine Tooker and Michael Corbally voted against carrying both ordinances. Mayor Vincent Barrella did not vote, but spoke in favor of carrying the ordinances to allow…

However, the vote was only for preliminary approval; a public hearing and adoption of ordinances still to come
The Point Beach Borough Council has voted narrowly for preliminary approval to mandate that bars stop serving alcohol at midnight or pay fees. Council members William Mayer, Tim Lurie and Stephen Reid voted against introducing a new ordinance calling for bars to stop serving alcohol at midnight and a second ordinance offering bars the option to pay a fee to serve from midnight to 2 a.m. Council members Kristine Tooker, Bret Gordon, Michael Corbally and Mayor Vincent Barrella voted yes on both ordinances. In the borough council form of government, the mayor only votes to break a tie. On last night's agenda, both concepts, i.e. mandating that bars stop serving alcohol at midnight and how they can pay a fee to serve beyond that time, were …
