Still pursuing lawsuit against parking plan, says attorney
Martell's is continuing to litigate against Point Beach's overnight parking plan, says the oceanfront bar's attorney. Martell's Seabreeze and Tiki Bar is not dropping its lawsuit against the parking plan the town had in place this past summer and plans to establish again this summer, says Ronald Gasiorowski, Martell's attorney. "Martell's isn't dropping anything," Gasiorowski said Thursday. In possible turn-around, Point Beach Republicans say they might be in favor of District 4 parking plan
Maybe the District 4 Parking Plan wasn't such a bad idea after all. Then again, maybe it was. Point Beach Republican candidates Andy Cortes and Stephen Reid, who had always been staunchly against the overnight parking restrictions established this summer for non-residents in District 4, now say that maybe they're in favor of it. If they're elected, would they vote for it next year? Maybe they would. But maybe they wouldn't. The two said at Thursday night's council candidates forum that they've been doing a lot of walking door to door and talking with residents in District 4 and beyond. An attorney for Jenkinson's and Martell's said he is willing to look at the mayor's proposal for dropping the local midnight bar closing law - but he wants to see it in writing. "He should have his attorney send me his proposal in writing," said attorney Ronald Gasiorowski on Thursday, when asked to respond to Mayor Vincent Barrella's comments at the Tuesday night Point Beach Council meeting. Seafood, wine, live music and pony rides and games for the kids are among the offerings at the Festival of the Sea in Point Beach on Saturday. The event, known locally as "the seafood festival" and sponsored by the Point Pleasant Beach Chamber of Commerce, is scheduled for 10 a.m. to 7 p.m., with Sunday scheduled as the rain date. The Festival of the Sea is a street fair located in the heart of downtown Point Pleasant Beach, where Arnold and Bay avenues will be closed for the festivities. Visitors can sample dishes by 25 of the area’s finest restaurants (from clam chowder to lobster to steak). There is no admission price to enter the festival. What's fun, what's closed and more
Here are some fun things to do in Point Beach area and beyond and some useful things to know during Labor Day weekend. Jenkinson's is having events all weekend, culminating in fireworks scheduled for the evening of Labor Day (wind and weather conditions permitting). And Jenkinson's rides will still be open next week, which may be good news for local kids since Borough schools don't open until Thursday and Beach schools don't open until Wed. While you're out driving around this weekend, get your car washed for a good cause. Fine now set at $48
District 4 parking plan tickets no longer require a court appearance and now cost $48, according to two Point Beach council members. The tickets can now be paid by mail or online, only requiring a mandatory court appearance for those pleading not guilty, wrote Point Beach Councilmember Michael Corbally in Patch Comments on Monday. "Letters will go out this week for folks who have received tickets prior to today," Corbally wrote. "Sorry for the confusion." Corbally could not be reached to elaborate. Judge Grasso denies motion for injunction filed by marina, charter boats and GOP officials
A Superior Court judge ruled Friday afternoon that Point Beach can continue operating its new District 4 parking plan for now, denying a motion filed by a group suing the town. State Superior Court Assignment Judge Vincent Grasso, sitting in Toms River, denied a request by a group of commercial charter boats, a marina and a small group of residents for an injunction to block the parking plan which restricts parking from midnight to 6 a.m. on municipal roads in District 4, said Municipal Attorney Sean Gertner. The group is suing the town to block the parking plan. Councilmember Kris Tooker, who was in Grasso's courtroom with some other municipal officials, said she was glad to hear the decision. District 4 parking plan warnings start Friday; ticketing starts June 22
District 4 businesses will get parking placards for employees so they are exempt from the District 4 parking plan restrictions that go into effect on June 22. The placards for employees will have the name and address of the businesses they work for, but not the names or addresses of individual employees, so the placards can be shared among employees, said Municipal Clerk Maryann Ellsworth on Wednesday. That was one of several revisions to the new District 4 parking plan that was adopted, as an ordinance, by Point Beach Council at Borough Hall on Tuesday night. Lawsuit follows one filed by boardwalk businesses against District 4 parking plan
The new District 4 Parking plan is unlawful because it reduces public access to the ocean and Manasquan River and discriminates between Point Beach residents and others, according to a lawsuit filed by several charter fishing boats, a marina and several Point Beach residents. Because the plan allows only residents and local taxpayers to park in District 4's metered spots between midnight and 6 a.m., it violates the Public Trust Doctrine, an underpinning of beach access laws that says members of the public should all have equal access to the waterways and beaches, regardless of where they live, according to a lawsuit filed by John J.
